Terms of service

TradeNight is operated by Forge atelier numérique inc. ("we," "us," or "our"). We operate a live online card trading platform at tradenight.club (the "Platform"). These terms of service ("Terms") are a binding agreement between you and TradeNight. By creating an account or using the Platform, you agree to these Terms.

If you do not agree, do not use the Platform.

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and trade on TradeNight. By using the Platform you represent that you meet this requirement.

You are responsible for keeping your login credentials secure and for all activity that occurs under your account. One person, one account. If you suspect unauthorized access, contact us immediately.

We reserve the right to suspend or terminate any account at any time, for any reason, at our sole discretion, with or without notice. This includes, but is not limited to, violations of these Terms or our acceptable use policy.

TradeNight hosts live trading events where collectors can post cards, negotiate trades in private trade windows, and confirm deals. We provide the venue and the tools. We are not a party to any trade between collectors.

Specifically:

  • We do not take possession of, ship, inspect, or authenticate cards.
  • We do not guarantee the condition, authenticity, or value of any card posted on the Platform.
  • We do not mediate or arbitrate disputes between traders beyond providing trade records.

When both parties confirm a trade, the Platform creates an immutable trade record. That record reflects what was agreed to on the Platform. Fulfillment (shipping, delivery, payment) is the responsibility of the traders involved.

You agree that confirmed trades represent a good-faith commitment. Backing out of a confirmed trade may result in negative vouches from the other party and potential account action.

TradeNight's reputation system is built on vouches tied to trade records after collectors confirm receipt of their incoming cards. When you leave a vouch, it must be honest and based on your actual experience with that trade. We may hide or remove vouches that violate our acceptable use policy (for example, fake, retaliatory, or abusive feedback).

6. Your content

You retain ownership of the photos, descriptions, and other content you post on TradeNight. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute that content as needed to operate the Platform (for example, showing your card photos in the live room feed, trade windows, and trade records).

You must not post content that infringes on someone else's rights or violates applicable law.

You agree not to:

  • Use the Platform for any illegal activity.
  • Post counterfeit, stolen, or misrepresented cards.
  • Harass, threaten, or abuse other collectors.
  • Manipulate the reputation system (including shill vouches, coordinated negative vouches, or buying/selling vouches).
  • Use bots, scrapers, or automated tools to interact with the Platform without our written permission.
  • Attempt to circumvent security measures, rate limits, or access controls.

Creating an account and joining live trade events is currently free. If we introduce paid features in the future, we will give you clear notice before any charges apply.

The Platform is provided "as is" and "as available." We make no warranties, express or implied, regarding the Platform, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee uninterrupted or error-free service. Live events depend on real-time systems, and temporary disruptions can occur.

To the maximum extent permitted by law, TradeNight's total liability for any claim arising from your use of the Platform is limited to the amount you paid us in the 12 months before the claim arose (or $100, whichever is greater).

We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of goodwill.

You agree to indemnify and hold TradeNight harmless from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Platform, your content, or your violation of these Terms.

We may update these Terms from time to time. When we make material changes, we will notify you by email or through a notice on the Platform before the changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.

You may close your account at any time through your account settings. We may suspend or terminate your access at any time, for any reason, at our sole discretion, with or without notice. Upon termination, your trade records and vouch history remain part of the Platform's permanent record.

These Terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any disputes will be resolved in the courts of competent jurisdiction in the judicial district of Montreal, Quebec.
